TERMS AND CONDITIONS OF HIRE
Booking Fee
All bookings will require a booking fee, the amount payable will be 20% of the booking cost. This enables us to make the item unavailable and cover admin cost's involved. Balances over £100 will need to be paid in full the Monday before delivery of equipment. Booking fee's are non refundable as they are used a part payment for your booking and is taken away from the total cost
Booking Deposit
A 20% non refundable deposit is required to confirm your booking and secure your event date. Some bookings may only require £50 deposit (unless agreed otherwise)
Balance Due
The balance due amount will need to be paid on the Monday before your event date. We do not accept any method of payment on the day or night. Kilmore Promotions will not be supplied to the hirer if the balance due amount has not been paid in full.
Behaviour
The hirer is held fully responsible for their's and their guest's behaviour. Company staff will not entertain abusive hirers and/or guests, and will cease to perform during instances of threatening behaviour. The Company reserves the right to end all services early, without prior notice or refund, in the interests of company staff safety.
Cancellations
The hirer may cancel the booking agreement at any time by doing so in writing to Kilmore Promotions. The booking deposit is non-returnable. Please click here to view our cancellation policy / a copy will also be attached with this letter for your attention.
Cancellations must be made in writing or from the bookers email address. For security reasons they will not be accepted over the phone.
Complaints
In the event of a complaint the hirer should attempt to rectify the problem with the company staff on the event date at the venue/location. Where this is deemed not possible complaints should then be made in writing to the company within 30 calendar days of the event date. Complaints will be fully investigated and a response made available to the hirer within 10 calendar days.
Delivery and Arrival
The company can give no guarantee to attend the venue address at the time stated in the Booking Agreement due to any circumstances that are out of the company's control, e.g. adverse weather conditions, heavy traffic, road closure etc. Best attempts will always be made by the company to deliver the services at the time stated.
Description
All drawings, descriptive matter, images, specifications and advertising issued by the company and any descriptions or illustrations contained in the company's catalogues or brochures and/or on the company's website are issued or published for the sole purpose of giving an approximate idea of the goods described in them. They will not form part of this contract.
Equipment Installation
All equipment hired will be suitably and safely installed by a member of competent staff. The company reserves the right to withdraw the use of certain equipment if at the time, it is deemed unsafe to use such equipment.
Equipment Operation
Only company staff may operate the company's equipment unless otherwise stated in your booking agreement. Under no circumstances may unauthorised personnel tamper, move or attempt to use equipment owned by the company. The company also cannot accept any responsibility for damage caused to the venue location, or injury caused to the hirer, the guests and/or the venue staff caused directly by third party unauthorised intervention.
Force Majeure
By booking our services you, the hirer agrees that the company shall not be liable for any and all losses, including damages, costs, claims, compensation and other liabilities which arise as a result of any delay or interruption in, or any non-delivery, missed delivery or failure of the equipment and/ or services due to circumstances beyond our or any of our suppliers' and contractors reasonable control (including, but not limited to, fire, lightning, explosion, war, disorder, flood, industrial dispute, sabotage, weather conditions, road closure, vandalism, traffic congestion, vehicle failure or acts of local or central government or other competent authorities).
Our maximum liability arising out of or in connection with the non supply of services on the event date and at the venue/location shall be limited to the total value of the booking agreement in pounds.
General
The booking agreement shall be governed by and construed in accordance with the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales. In the event that the agreement is translated into any other language, the English language version shall prevail. You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party.
In the unlikely event that you are not happy with the service from the company we will investigate matters arisen and come to a suitable outcome.
If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
Equipment
The company will deliver, set up and make sure that all LED dance floors are in good working order before the company staff leave. From time to time spilled drinks, metallic confetti and jumping on the dance floor can stop panels from working. The company will not issue a full or part refund in this case.
In the rare occasion that the photo booth printer stops printing, the company staff will give the client the option to receive photo prints at a later date and continue the photo booth or end hire and receive a part refund. If the client agrees to continue with the hire of the photo booth, no refund will be given, But a free usb pen and a copy of any missing prints will be given in replace.
Health and Safety
It is solely the responsibility of the Hirer to ensure the Venue complies with current Health & Safety Regulations, holds all necessary certification including Public Liability Insurance, Public Performance Licenses, and where applicable, relevant PAT test certification. The Company will ensure their equipment fully complies with the relevant and current Health & Safety legislation regarding the Equipment and Company Staff.
It is the responsibility of the Hirer and/or the Venue to provide a safe & suitable area within the Venue Location to facilitate installation of the Equipment. Any floor surface, staging, mounting area or electricity supply which is deemed unsuitable or unsafe by the Company Staff may delay or prevent installation of the Equipment. If installation cannot be completed successfully the Company cannot provide the Hirer with any Disco Services. In this event no refunds, in part or full, will be given for non-use of Equipment that cannot be used due to any Health & Safety implications imposed on the Company by the Hirer and/or the Venue.
Illness & Accidents
In the event of accident or illness preventing the company not providing the services the Hirer shall be informed at the earliest opportunity. The Hirer shall not be obliged to pay the company fee for any performance(s) in respect of which the service is unable.
Insurance and Damage
The Hirer assumes all responsibility for all equipment once it is installed at the venue/location. It is the responsibility of the hirer to arrange appropriate insurance for the event period. Company vehicles and equipment damaged by the hirer or the guests will be charged to the hirer at replacement cost.
Space and Electrical Supply
A flat, clear and safe surface must be provided by the hirer and/or the Venue. A minimum area of 3 metres width by 2 metres depth by 2.4 metres high is required to facilitate correct & safe set up and installation of the most equipment. It is the hirer's responsibility to ensure that there is sufficient and safe power available at the Event Location.
2 x 13A sockets are required as a minimum electrical supply.
Payments
Payments can be made using debit or credit cards. We also accept bank transfers
Performance
Start and Finish times are clearly indicated on this agreement. These times can be altered, subject to availability, before the event date.
Prices and Quotations
All package prices are fully inclusive of delivery, labour, and insurance. Quotations are valid for 7 days.
Venue Access
The Hirer and/or the venue must make at least one safe & suitable parking space with no height restriction available to the company staff, at no cost to the company, to facilitate safe & prompt unloading of the equipment. The Hirer shall notify the company at least 14 calendar days prior to the event date if the Hirer and/or the Venue are unable to provide the above. In this event the Company reserves the right to make its own parking arrangements and charge this cost in full to the Hirer.
The hirer and/or the venue shall notify the company at least 7 calendar days prior to the event date should the equipment be required to be installed in a position other than on a ground floor location. Failure by the Hirer to notify the company of the correct set up location may result in delay or prevent installation of the equipment. If installation cannot be completed successfully the company cannot provide the Hirer with any Services. In this event no refunds, in part or full, will be given for non-use of equipment that cannot be used due to any installation and/or access restrictions imposed on the company by the Hirer and/or the Venue. The company reserves the right to allow Company Staff any additional time required to complete unloading & installation at the Venue Location if the access is deemed 'Non Standard' by the Company Staff on the Event Date.
Venue Restrictions
It is the Hirer's responsibility to ensure all equipment booked (including any additional options ordered by the Hirer) is suitable for use at the venue/location. No refunds, in part or full, will be given for non-use of Equipment that cannot be used due to any Venue restrictions imposed. Not all Equipment is designed to fit through narrow doorways and/or up staircases. It is the Hirer's responsibility to inform the Company of any access restrictions that may impede set up or Venue rules/regulations that may restrict or completely prevent specific equipment use. Performance start times may be significantly delayed if the Venue Location is not on ground floor level and the Company has not been informed of this fact, by either the Hirer or the Venue, prior to the Event Date.
Cancellation Policy
Once you have placed an order you have entered into a contract, However we understand that cancellations are needed to be made from time to time, our cancellation terms are outlined below and are designed to be very reasonable. The policy is only in place to protect both our and your best interests and ensure that our out of pocket expenses are covered. It is not designed to be profitable on our part.
Cancelling Part Orders:
Cancelling part of your order will result in an administration charge of £75.00 per item that will need to be re-listed to our online booking system, This charge will also cover us if we cannot find another booking to hire the items you booked.
Orders between £100 and £200: Cancellations are accepted but must be made at least 7 days in advance of the event in order not to incur a cancellation charge. Cancellations made between 7 days in advance of the event and up until 12noon on the day before your event will be subject to a 50% cancellation fee (Reduced to 15% if paid within 7 days) to cover our costs. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Orders between £200 and £400: Cancellations are accepted but must be made at least 14days in advance of the event in order not to incur a cancellation charge. Cancellations made between 14 days in advance of the event and up until 12noon on the day before your event will be subject to a 50% cancellation (Reduced to 20% if paid within 7 days) fee to cover our costs. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation (Reduced to 50% if paid within 7 days) fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Orders over £400: Unfortunately all orders over the value of £400 are subject to a 50% cancellation fee) regardless of when the order or cancellation is made due to the large amount of preparation and event management that will have taken place already that must be recovered. Should your order be cancelled after 12noon on the day before your event or on the day of the event (including refusal of delivery on arrival) your order will be subject to a 100% cancellation fee (Reduced to 50% if paid within 7 days) to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not.
Cancellations on arrival due to not fitting: All sizes and dimensions are clearly displayed on our website. Should we arrive on the day and the items not fit in your chosen venue or event area your order will be subject to a 100% cancellation (Reduced to 50% if paid within 7 days) fee to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, vehicle & generator hire and staff commitments which will now have to be paid for regardless of weather your event goes ahead or not. No exceptions. We will try our best to provide an alternative or accommodate the relocation of the entertainment, however our event staff will only have a finite amount of time allocated to your booking and must keep a tight schedule in order not disrupt other bookings on that day.
Refusal of delivery
Should our team arrive at your venue and for whatever reason you cancel the booking your order will be subject to a 100% cancellation fee (Reduced to 50% if paid within 7 days) to cover cost already laid out for your booking such as the testing and organising of your entertainment, loading up, fuel costs, vehicle & generator hire and staff commitments which will have to be paid for regardless of weather your event goes ahead or not.
WET OR BAD WEATHER IS NOT A VALID REASON FOR TURNING US AWAY WITHOUT NOTICE AND THE CANCELLATION CHARGE WILL STILL APPLY.
The only way in which to avoid a penalty is to provide our delivery team with a copy of your Cancellation Confirmation. Failure to pay on the day will result in your case being presented to debt collection company to recover the costs.
